New York Compliance Testing for Cannabinoid Hemp Products

New York hemp brands must follow the revised cannabinoid hemp regulations, effective December 13, 2023, which introduced stricter potency, THC ratio, and safety requirements for all products sold statewide. Each compliant item must include a QR code linking to its verified Certificate of Analysis (COA). ACS Laboratory tests according to these updated OCM standards, ensuring products meet analyte, contaminant, and labeling thresholds.

Cannabinoid Potency

Matrix: Flower/Plants, Derivatives, Edibles, and Beverages

ACS Laboratory measures XXX total cannabinoids—including Delta 9-THC, THCA, CBD, and CBDA—using validated HPLC-UV and LC-MS/MS methods to confirm products contain no more than 0.3% total Δ9-THC and meet New York’s potency ratio limits:Flower and Topicals: Standard 0.3% total Δ9-THC limit.

Concentrates and Vapes: Minimum 15:1 CBD-to-THC ratio (or total cannabinoids-to-THC ratio if CBD isn’t primary).

Edibles and Beverages: 15:1 ratio, 1 mg THC per serving, 10 mg THC per package.

Tinctures: 15:1 ratio, 1 mg THC per serving, 100 mg THC per package.

ACS verifies each product’s labeled potency within ±20% accuracy to ensure compliance with OCM standards.

What information must be included on the label or packaging of cannabinoid hemp products sold in New York State?

Effective January 1, 2024, product labels or packaging must include a list of all ingredients, the number of servings and milligrams of CBD/THC/other marketed cannabinoids per serving (for most products), an expiration/best by date, a lot/batch number, the processor/manufacturer/distributor's name, a scannable bar code or QR code linking to a CoA, the state/country of origin of the hemp, a means for reporting adverse events, recommended serving size, clear usage instructions, and specific warnings.
