ACS Laboratory is proud to serve as a third-party laboratory under the Texas Department of Agriculture (TDA), providing compliant testing for consumable products. ACS is DEA-registered and ISO/IEC 17025:2017 Accredited by A2LA. It delivers precise, state-approved results that help Texas hemp operators meet legal standards and build consumer trust. 

Industrial Hemp Plant Testing (Not Available in Texas)

Texas hemp growers must complete pre-harvest THC testing through a TDA-approved third-party lab and verify total delta-9 THC does not exceed 0.3% on a dry-weight basis. ACS Laboratory does not perform this service but offers plant health R&D testing to support cultivation performance.

Consumable Hemp Testing (5-panel test)

Texas hemp processors trust ACS Laboratory for Texas Department of State Health Services (DSHS) compliant testing. We measure cannabinoids, solvents, heavy metals, pesticides, and pathogens, issuing accredited COAs with QR links and measurement-of-uncertainty data.

Texas Pre-Harvest Testing for Hemp Plants

Texas law requires licensed growers to complete pre-harvest compliance testing through an approved laboratory. A TDA-licensed agent must collect representative plant samples within 15 days of harvest, which are analyzed to verify total delta-9 THC ≤ 0.3 % on a dry-weight basis. Laboratories must report results to TDA within 14 days.

ACS Laboratory tests hemp samples for 32 cannabinoids using HPLC-UV, far exceeding Texas’s baseline potency requirement. Results include total Δ9-THC, Δ8-THC, and minor cannabinoids such as CBDV, CBG, CBC, and CBN, reported with measurement-of-uncertainty to confirm compliance within the 0.3 percent THC limit.

What do Texas’s latest hemp rule updates mean for brands and testing?

In October 2025, the Texas Department of State Health Services enacted an emergency rule prohibiting the sale of consumable hemp products containing synthetic cannabinoids or more than trace THC to anyone under 21. This rule followed a failed legislative attempt to ban all hemp-derived psychoactive products. The emergency rule remains in effect while the state develops permanent restrictions on youth access and product safety.

ACS Laboratory typically delivers Texas compliance tests 5–7 business days after receiving samples. Expedited services may be possible for compliance-critical batches or product launches.

Can I sell or manufacture hemp flower or vapes in Texas?

Licensed growers may cultivate hemp flower, but manufacturing smokable or inhalable hemp products is prohibited under state law. However, retailers may sell smokable hemp legally manufactured outside Texas under the 2022 DSHS v. Crown Distributing ruling.
