  • The FDA has notified brands that shipping certain CBD products between states violates the FD&C Act. 
  • Companies have received warning letters for illegally selling unapproved CBD products claiming to treat cancer, Alzheimer’s disease, opioid withdrawal, and pain, among other conditions. 
  • The FDA worked with the Federal Trade Commission (FTC) to warn companies against selling copycat products with packaging that resembles traditional foods like chips, cookies, candy, and gummies. 

The FDA has indicated that some risk-management tools for CBD products could include clear labels, imposing CBD content limits, and testing CBD for contaminants.
